Can mortgage or rent arrears be included under A Debt Arrangement Scheme?
Yes, A Debt Arrangement Scheme does cover mortgage and rent arrears, but a normal monthly mortgage payment will not be included. You must still be able to meet your regular monthly mortgage payment.

What debts cannot be included?
All debts can be included under A Debt Arrangement Scheme bar two; child support arrears and benefit deductions. Child support is a priority debt and unlike other debts you cannot be protected against enforcement of arrears by your Debt Payment Plan (DPP). Where you are having direct deductions made from your benefit – for example for council tax debt, fines, social fund loans or benefit overpayments – again these cannot be included for the same reasons. Only once you have stopped claiming benefits can these debts can be included.

How do I find an approved money adviser?
There are two ways to find a money adviser to talk to about the A Debt Arrangement Scheme; either through an advice agency who can refer you to one or you can go directly to one. Lists of both agencies and money advisers can be found at www.moneyadvicescotland.gov.uk

Can my creditors stop the DPP being approved?
Usually no. If your DPP is fair and reasonable and your money adviser suspects that your creditor is being deliberately difficult, they will still go ahead and send your DPP for approval.

Can my creditors still sequester me?
As long as you keep up the payments under the DPP they cannot take any action against you. A DPP even cancels most forms of diligence action, such as earnings arrestment and property attachment if you have not reached the auction stage.

What if I can’t keep up payments on my plan?
If your circumstances change, your money adviser can apply to the A Debt Arrangement Scheme administrator to vary the terms of your payment plan. Again, as long as these changes are fair and reasonable, you should still be able to continue with your plan.

Can the DPP be cancelled?
A DPP will be cancelled if you are sequestered or if the A Debt Arrangement Scheme administrator or creditor makes an application for it to be cancelled giving good reason.

Do I have to hand over my assets to the money advisor?
Not necessarily. In the course of their financial evaluation, your money adviser will look at what assets you have. You may find that they request any unusually valuable items – such as a very expensive car that has no finance attached – be downgraded to a less expensive model to release some cash. Generally items that are used for day-to-day living, such as required medical aids or the tools and vehicles needed if you are self-employed, will be exempt.

Will I have to sell my home?
Usually no, although if you have equity in your home the money adviser or A Debt Arrangement Scheme administrator may request you remortgage to release some cash to creditors.

Can I still apply for loans and credit cards while paying off my debts under the A Debt Arrangement Scheme?
You may still be able to have some access to credit, but it will be far less than usual and capped at a certain level. However, a DPP will negatively affect your credit record so it is unlikely you would find a lender willing to offer you credit under after your DPP is complete.

What if I have an arrestment order already?
If your creditors have secured an attachment or arrestment of your income, funds or property, this will cease under A Debt Arrangement Scheme on approval of your DPP. The only exception to this is where your benefits are being deducted directly.

Can I appeal if my A Debt Arrangement Scheme application is refused?
You always have the right of appeal. With A Debt Arrangement Scheme, you can appeal to the sheriff court for your case to be heard. You can also appeal if you do not agree with any conditions the A Debt Arrangement Scheme administrator has added to your payment plan or if they have refused a change to the plan that you have requested.

What happens at the end of the DPP?
Once you make your final payment your obligation to your creditors has been fulfilled, and the fees and charges that were suspended at the start will be cancelled. However, your DPP could end early if your creditors agree to take a lump sum part payment to settle the debt.

What is the A Debt Arrangement Scheme register?
A register of everyone on A Debt Arrangement Scheme is kept by the A Debt Arrangement Scheme administrator and once approved you will also be entered into that register. Only creditors and your money adviser have access to it once they have paid a fee; the general public has no right to see any of the information.
